Cabin Rental Agreement Between Guests
and Smoky Cove Chalet and Cabin Rentals, LLC, Agent for Property Owners
CHECKIN TIME IS 3 P.M./CHECKOUT TIME IS 10:00 AM
Failure to depart the cabin on schedule will result in additional charges.
RATES AND MAXIMUM OCCUPANCY
Rates are based on the maximum occupancy for each individual rental property and may not be exceeded. You must provide the reservation staff with the number of guests, including children, when making your reservation. All children must be included in the occupancy total. For fire safety reasons, all individuals occupying the rental property during your stay must be accounted for. If you are found to exceed the maximum occupancy of your cabin, Extra guests will be asked to leave immediately. A second violation of the maximum occupancy will result in immediate eviction with no refunds or rebates.
GROUPS ARRIVING AT DIFFERENT TIMES
The registered guest must contact Smoky Cove Chalet and Cabin Rentals, LLC and the reservation must be paid in full along with all necessary paperwork to be completed before anyone may check in. This includes all credit card slips signed, along with guest agreements, imprint of credit cards and copy of Driver Licenses.
DAMAGE DEPOSITS / DAMAGE TO PROPERTY
Premises are to be left in orderly, undamaged condition. Additional charges may be assessed to cover repairs to structure, furnishings, our outdoor amenities, or additional cleaning services beyond typical house cleaning. Each reservation requires a damage deposit at check-in. Damage deposits for check-ins after office hours will be processed the next business day using the credit card on file. This damage deposit is NOT included in your reservation total on your confirmation sheet.
GARBAGE DISPOSAL
All garbage must be bagged in trash bags provided and placed in outdoor containers or on the porch prior to departure. Failure to properly bag and/or remove garbage from cabin will result in assessment of additional charges not to exceed $15.00.
AGE OF GUESTS
Reservations must be made by adults twenty-one (21) years of age or older. Any guests under the age of 21 must be accompanied by a guest over the age of 21. Minors must be supervised by an adult over the age of 21 at all times. Guests violating this policy will be immediately evicted from the cabin with no refund.
OWNER'S CLOSET
Some rental cabins have a locked, private owner's closet that is not accessible by guests. Guests agree not to enter these closets.
RIGHT OF ENTRY
Agent reserves the right to enter property to investigate disturbances, check occupancy, check damages, and make repairs as Agent deems necessary. Agent will attempt to notify guest when service/repair entry is to take place.
GAS LOG FIREPLACES and GAS FIRE PITS
Gas log fireplaces and fire pits are designed to burn only gaseous propane. Guests agree not to put anything in the fireplace or fire pits or attempt to use the gas log fireplace or fire pit to cook anything (marshmallows, hotdogs, popcorn, etc.) Please be aware that gas fireplaces are typically operational from October through April.
CHARCOAL GRILLS
Some cabins are equipped with a charcoal grill. Guests must provide their own charcoal. Guests agree to put used charcoal and ashes only in the supplied ash bucket. DO NOT DUMP CHARCOAL OR CHARCOAL ASHES ON THE GROUND, PAVEMENT, OR IN THE GARBAGE, NO MATTER HOW OLD OR COLD THEY ARE.
HOT TUBS / SWIMMING POOLS
Guests will not put any objects or chemicals into the hot tubs or pools including but not limited to glass items, beer cans, wine bottles, suntan lotion, bubble bath, or toys. These items can damage the equipment or create safety hazards. Guest agrees to pay all repair costs if the equipment is damaged.
FURNISHINGS/FURNITURE
All furnishings/furniture in the cabin are in place as the owners wish them and Guests agrees to leave furnishings in their original arrangement
LONG DISTANCE TELEPHONE CALLS
Long Distance telephone calls are disabled from our properties except those noted as having unlimited free long distance.
SMOKING
All cabins are non-smoking and smoking is permitted only on decks or driveways. Cigarette and cigar butts must be properly and safely disposed of. DO NOT THROW OR PLACE CIGARETTE, CIGAR, OR PIPE ASHES ON GROUND OR PAVEMENT. Guest agrees to pay not less than $350 for odor abatement if they smoke or allow smoking in the cabin.
HOUSE PARTIES - EXCESSIVE SPEEDING - DISTRUPTIVE BEHAVIOR - FIREARMS - FIREWORKS
Occupancy and use of premises shall not disturb or offend neighbors or residents. House parties, keg parties, excessive speeding, excessive noise and/or disruptive behavior, discharging of Firearms, BB or Pellet Guns, or Fireworks, etc. will result in guest vacating the property immediately without refund.
ALCOHOLIC BEVERAGES/ILLEGAL DRUGS
Consumption of alcoholic beverages in rental units is limited to persons of legal age. Illegal drug use is strictly prohibited.
WILDLIFE AND INSECTS
Cabins at Smoky Cove are located in the mountains and woods. Bear, Deer, Turkey, Ladybugs, Bees, Wasps, Scorpions, Ticks, Ants, Chiggers, etc. may be encountered outside. Smoky Cove Chalet and Cabin Rentals, LLC cannot control their activity and will not offer refunds, discounts, etc. in the event that outdoor wildlife disturbs guests. Guests are encouraged to dress accordingly and to bring insect repellent for outdoor activities.
PET POLICY
Pets are not permitted in cabins except those designated as pet friendly. Signed Pet Policy Agreement must be on file before any dogs are allowed in cabin. Guests agree to pay not less than $100 cleaning fee if pets are brought into the properties. Pets must be completely housebroken, well behaved, and pest free. Guests agree to bring portable pet kennels for their pet to stay in when the owner is not in the cabin. Guests agrees to be in full control of their pets at all times and take full responsibility for their pet's well being.
NO SHOW/EARLY DEPARTURE POLICY
No refunds, discounts, or rebates will be offered for guests that do not arrive at all, arrive late or leave early. Guest will still be charged the full amount of the reservation plus any applicable fees and taxes.
CANCELLATIONS, RESCHEDULING, OR CHANGES
Effective May 11, 2010, Smoky Cove Chalet and Cabin Rentals, LLC has instituted the following cancellation policy: Any reservation cancelled 30 days or more prior to check-in date will receive full refund minus $125.00 processing fee. Cancellations made less than 30 days prior to check-in date will result in complete forfeiture by Guests of all payments made to Smoky Cove Chalet and Cabin Rentals, LLC. Only the guest named on the reservation may notify Smoky Cove Chalet and Cabin Rentals of a reservation cancellation.
REFUNDS/REBATES
This Cabin Rental Agreement is a legally binding agreement between Guest, Agent & Owner. Your reservation binds you to a specific period of time. Agent will make every effort to correct any problem that arises during your stay in a timely manner. There will be no refunds or compensation for: Acts of God or Mother Nature, inclement weather, acts of war or government agencies, road maintenance, or public utility failure.
REFUSAL OF SERVICE
Agent reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, or handicap. Due to liability issues, Agent will be unable to provide prospective renters with directions or keys to preview properties without Agent present.
TERMINATION BY OWNER/SUBSTITUTIONS
Agents strive to comply with all reservation requests for specific vacation properties. However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstances, Agents cannot absolutely guarantee a specific property. Agents reserve the right to change property unit assignment without liability should rental property become unavailable. Where comparable properties are not available, Guests will have the option of selecting from available properties at the published rate or receiving a full refund.
VIOLATION OF AGREEMENT/CONTRACT
Agent reserves the right to remove renter without refund if any of the above agreed upon items are not met. Renter agrees that the credit card used at check-in is the card that shall be used for damage/cleaning/additional person and/or pet charges and that their signature on this contract authorizes same. Failing authorization, the card used for the rental deposit shall be used, and their signature on this contract authorizes same.
EXPEDITED EVICTION
A material breach of this Agreement by Guests, which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.
INDEMNIFICATION AND HOLD HARMLESS
Guests acknowledge, understand, and agree that Guests shall be solely responsible for any property damage, accident, or injury to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guests use of the premises. Guests hereby agree to INDEMNIFY and hold Smoky Cove Chalet and Cabin Rentals, LLC, employees, owners and officers; and/or Homeowners harmless from any and all claims including those of third parties, arising out of or in any way related to Guests use of premises or the items of personal property provided therein. Guests hereby agree to hold Smoky Cove Chalet and Cabin Rentals, LLC and/or homeowner, its Agents, employees and officers harmless and to indemnify same against any and all claims which may arise during and after the course of rental as a consequence of any acts or omissions of Smoky Cove Chalet and Cabin Rentals, LLC and/or cabin owner, its Agents, employees and officers. Guests assume the risk of injury or other losses relating to any recreational activities and will hold owner and its Agents harmless with respect there to.
DISPUTES
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Tennessee.
